UK 10-Year Settlement Rule Confirmed (November 2026): What It Means for Punjab Workers and Families
Short answer: On 2 November 2026 the UK Home Office published its response to the earned settlement consultation and confirmed the UK 10-year settlement rule: the default wait for Indefinite Leave to Remain (ILR) will rise from 5 to 10 years. Faster 3-year and 5-year pathways will exist for higher earners and some public service workers, and many care workers who arrived before May 2025 keep a 5-year route. The detailed Immigration Rules and start dates have not been published yet.
In October we explained that the earned settlement plan was still only a proposal (see our UK ILR earned settlement update from October 2026). That has now changed. Many families in Jalandhar, Kapurthala, Nawanshahr, Hoshiarpur and across Punjab have a son, daughter or spouse in the UK on a Skilled Worker or Health and Care Worker visa, so this update sets out what the government has actually decided, using the official GOV.UK documents only.
What the Home Office Announced on 2 November 2026
The Home Secretary set out the new settlement framework in Parliament on 2 November 2026, and the Home Office published A Fairer Pathway to Settlement: Government response to the consultation on the same day. The GOV.UK press release says settlement status will not be removed from anyone who already holds it, and that partners, parents and children of British citizens keep their current 5-year pathway.
The key principle is that settlement must be "earned" through contribution, not granted on time alone. Before the changes take effect, the government says it will publish detailed Immigration Rules, further guidance and a full impact assessment.
The UK 10-Year Settlement Rule: Four Pathways at a Glance
Pathway | Who it is for | Earnings test in the government response |
|---|---|---|
3 years | Exceptional economic contribution | £125,141 a year for 3 years (or 3 of the last 4 years), or the "highest talent" group, which is still being reviewed |
5 years | Strong contribution | £50,271 a year for 3 of the last 5 years, or 5 years in an eligible public service job, or a British connection |
10 years | The new default for people who follow the rules | At least £12,571 a year for 5 of the previous 7 years |
20 years | People whose immigration breaches or use of public funds rule out an earlier route | Same earnings test as the 10-year pathway |
The response also sets a household figure of £25,142 for couples, which is twice the individual minimum. All thresholds stay linked to UK income tax and National Insurance thresholds, so they can move over time.
Mandatory Requirements for Everyone
Whatever the pathway, the government response says applicants must meet these requirements (with exemptions in some cases, but never for criminality):
Good character and suitability: a clean criminal record. The press release says this will be stricter than the current threshold.
No debt to the government: for example unpaid NHS charges or tax.
English at B2 level: up from B1. Separately, Statement of Changes HC 1691 already confirms B2 English for settlement on routes such as Skilled Worker from 26 March 2027.
Life in the UK test: still required, and the government is reviewing it.
Sustained contribution: normally shown through earnings and National Insurance contributions.
What Changed Between the Proposal and the Final Decision
Issue | November 2025 consultation | November 2026 government response |
|---|---|---|
Default wait | 10 years proposed | 10 years confirmed |
Earnings figures | £12,570, £50,270 and £125,140 | £12,571, £50,271 and £125,141 |
Lower-paid Skilled Worker roles | A 15-year baseline was floated as an option | No 15-year pathway appears in the final pathway table |
Care workers already in the UK | Covered by the general proposals | Transitional protection for those who arrived or switched before the May 2025 White Paper |
Time as a student or graduate | Unclear for many families | Time on Student and Graduate visas does not count towards settlement |
Long Residence route | Under review | The route will close (date not yet announced) |
Who Is Affected in Punjabi Families
Your situation | What the government response says |
|---|---|
Skilled Worker earning below £50,271 | The 10-year default pathway applies, unless you qualify for a faster route |
Skilled Worker earning £50,271 or more for 3 of the last 5 years | You may qualify for the 5-year pathway |
Skilled Worker who came before April 2024 on lower transitional salary rules | You can extend on current terms until 2035 |
Care worker who arrived or switched before the May 2025 White Paper | You keep a 5-year route if you meet the £25,000 salary, sponsorship and employment requirements; if not, you can apply for a further 5-year Health and Care visa |
Health or education worker below RQF level 6 on a national pay scale (for example a nursing auxiliary or teaching assistant) who came before May 2025 | You keep a 5-year route if you meet your visa requirements |
Child under 18 on a parent's visa | Exempt from the income, debt, English and Life in the UK requirements |
Young adult aged 18 to 24 still on child dependant status | Exempt from the individual income test but must meet the other adult requirements |
Spouse or partner of a British citizen | Keeps a 5-year pathway (see our UK spouse visa guide) |
Student or graduate from Punjab | Student and Graduate visa time does not count towards settlement |
When Will the New Rules Start?
The government response does not give one start date for the whole framework. It says detailed rules, guidance and an impact assessment will come first. The only firm date in the response itself is 1 February 2027, for new protections for care workers whose sponsor loses its licence. UK law firms report that the Home Secretary told Parliament the changes will begin to be laid from the December Immigration Rules and be implemented over 2027, so expect several stages rather than one big switch.
Until the new rules are laid, the current ILR rules continue to apply. If you are close to 5 years, speak to an adviser about your exact dates, because applications are generally decided under the rules in force on the date of the decision.
Checklist: What UK-Based Workers from Punjab Can Do Now
Work out your current ILR date and keep every visa grant letter, BRP or eVisa record and travel date in one place.
Keep your UK absences within the continuous residence limits, and never let your permission lapse.
Collect P60s, payslips and HMRC records for every year, because the new pathways depend on earnings over 5 to 7 years.
Check whether your English evidence will meet B2, and book an approved Secure English Language Test early if needed. Our IELTS score requirements by country guide explains the bands.
Clear any NHS charges, tax or other government debt.
If you are a care worker, keep proof of when you entered or switched into the route and of your salary.
Prepare for the Life in the UK test so it does not delay your application.
Follow GOV.UK for the new Statement of Changes. Do not rely on WhatsApp forwards or social media summaries.
What This Means for Students Planning the UK from Punjab
For students in Jalandhar and across Punjab, the message is simple: a UK degree and the Graduate visa do not count towards settlement. If long-term settlement matters to you, plan your career path carefully. A Skilled Worker job with a higher salary may lead to a faster pathway, while a lower-paid job will most likely mean the 10-year default. Our UK Skilled Worker visa guide explains how that route works today.
