Short answer: As of October 2026, the UK's plan to make most migrants wait 10 years instead of 5 for Indefinite Leave to Remain (ILR) is still only a proposal. The Home Office consultation closed on 12 February 2026, no outcome has been published, and no start date has been announced. One change is already law: from 26 March 2027, settlement applications on routes such as Skilled Worker will need English at CEFR level B2 instead of B1.

Many families in Jalandhar, Ludhiana, Kapurthala, Hoshiarpur and across Doaba have a son, daughter or spouse in the UK on a Skilled Worker or Health and Care Worker visa. Most planned on ILR after five years. Since the Home Office published its earned settlement proposals, WhatsApp forwards and social media posts have caused a lot of worry, and many of them mix up what has been decided with what has only been suggested. This update sets out the UK ILR earned settlement position as it stands, using only official GOV.UK documents, and explains what Punjabi workers in the UK can do now.

The Confirmed Change: B2 English for Settlement from 26 March 2027

The explanatory memorandum to Statement of Changes HC 1691 says the English language requirement for settlement rises to B2 on routes where it is currently B1. The routes named include Skilled Worker, UK Ancestry, Global Talent, Scale-up, Innovator Founder, Long Residence and Private Life. The Home Office says the change comes into force on 26 March 2027 and will apply to people already on a pathway to settlement. It delayed the start date so that people have time to meet the higher level.

In practical terms, a worker who entered the UK before 8 January 2026 with B1 English may need to prove B2 if they apply for ILR after the new rule starts. If your five years complete before 26 March 2027, check the exact wording of the rules and your own dates carefully before deciding when to apply.

What you can do now:

  • Check whether the English evidence you already have, such as an approved test or a degree taught in English, will be accepted at B2 for settlement.

  • If you need a new test, use only a Home Office approved Secure English Language Test (SELT). Approved tests include IELTS for UKVI, PTE Academic UKVI, LanguageCert SELT tests and Skills for English UKVI. The minimum score for each level is on the GOV.UK SELT page.

  • Book early. Test dates fill up when a rule change is close.

The Proposal: 10-Year Earned Settlement

In November 2025 the Home Office published A Fairer Pathway to Settlement. It proposes that ILR is no longer granted automatically after a fixed period. Instead, migrants would "earn" it through conduct, contribution and integration. The main proposals are:

  • Baseline: the qualifying period rises from 5 to 10 years.

  • Mandatory requirements: no criminal convictions and no NHS, tax or other government debt; B2 English; a pass in the Life in the UK test; and a record of earnings above £12,570 a year for 3 to 5 years (the exact length was under consultation).

  • Possible longer wait: a 15-year baseline was put forward as an option for Skilled Worker roles below RQF Level 6, including Health and Care Worker roles below that level.

  • Reductions: C1 English (1 year less); taxable income of £50,270 for 3 years (5 years less); taxable income of £125,140 for 3 years (7 years less); 5 years in specified public service jobs at RQF Level 6 or above, such as medical and teaching roles (5 years less); and community volunteering (3 to 5 years less).

  • Increases: claiming public funds (5 or 10 years more), and up to 20 years more for illegal entry, entry on a visit visa or overstaying.

  • Family of British citizens: partners, parents and children of British citizens who meet the family requirements would keep a 5-year route.

The consultation proposed that the new model would apply to everyone who does not yet have ILR when the rules change, including people close to qualifying. Transitional arrangements were also part of the consultation. The GOV.UK page still says the Home Office is analysing the feedback, so none of these points is final.

Checklist: What UK-Based Workers from Punjab Can Do Now

  1. Work out your expected ILR date under the current rules and keep all visa grant letters and travel dates in one place.

  2. Keep absences from the UK within the continuous residence limit (generally no more than 180 days outside the UK in any 12-month period).

  3. Check your English evidence against B2 and book an approved SELT early if you need one.

  4. Prepare for the Life in the UK test so it does not delay your application.

  5. Keep payslips, P60s and tax records organised, because the proposals link settlement to earnings and contribution.

  6. Never let your permission lapse. Apply to extend before your current visa expires.

  7. Keep family documents ready, such as marriage and birth certificates with translations, for dependants.

  8. Follow GOV.UK for the consultation outcome and any new Statement of Changes. Do not act on forwarded messages.

What This Means for Families Planning a UK Move from Punjab

If you are in Jalandhar or elsewhere in Punjab and planning a UK job or study route, plan as if settlement could take longer than five years. That affects how you weigh costs, the right course or job, and whether a spouse should travel with you. Read our UK Skilled Worker visa guide for the work route, and our UK spouse visa guide if a family member is joining a partner in the UK. Students should also read our update on UK student visa changes for 2027.
