Canada Spouse Open Work Permit 2026: Eligibility, Fees and Checklist for Punjab Families
Short answer: Since 21 January 2025, a spouse or common-law partner can get a Canadian open work permit only if the principal is either (1) an international student in a master's program of 16 months or longer, a doctoral program, an eligible professional degree at a university or a specific listed program, or (2) a foreign worker in a TEER 0 or 1 job, or a select TEER 2 or 3 job in a priority sector, with at least 16 months left on their work permit. Government fees are CAD 255 (CAD 155 work permit fee plus the CAD 100 open work permit holder fee), plus CAD 85 for biometrics.

Route 1: Spouses of International Students
The student must hold a valid study permit and be enrolled in one of these:
A master's degree program of 16 months or longer.
A doctoral degree program.
A professional degree program at a university that appears on IRCC's list.
One of the specific programs or pilots IRCC lists, such as certain Ontario, Manitoba, British Columbia and Quebec programs and the Francophone Minority Communities Student Pilot.
To prove eligibility, the spouse usually shows the student's letter of acceptance, proof of enrolment letter or transcripts from the current program, plus proof of the relationship. IRCC says the spouse's permit is, most of the time, valid for the same period as the student's study permit.
Why the PG diploma route no longer works for most couples
Before 2025, many Punjab couples used a one- or two-year college postgraduate diploma so that the spouse could work full time. Under the current rules, most college diplomas, PG diplomas and bachelor's programs do not give the spouse an open work permit, unless the program is specifically named by IRCC. Be very careful with anyone who tells you "spouse visa is included" with a college admission. Ask for the exact program and check it against IRCC's list yourself.
Extending the spouse's permit
To extend under this route, IRCC's page says the student must have a valid study permit, be a full-time student in a PGWP-eligible program at a DLI and not be in the last term of the program. Route 2: Spouses of Foreign Workers
If the principal is working in Canada, the spouse may qualify when:
The worker is employed in a TEER 0 or 1 occupation, or in a select TEER 2 or 3 occupation in sectors IRCC links to labour shortages or government priorities. IRCC names sectors such as natural and applied sciences, construction, health care, natural resources, education, sports and the military.
The worker has at least 16 months left on their work permit when the spouse applies.
Two more points matter for families. First, dependent children of foreign workers are no longer eligible for family open work permits. Second, permits approved under the old rules stay valid until they expire, and in-Canada family members can renew under the same criteria as their current permit if the renewal period matches the principal's permit. IRCC also says spouses of workers covered by free trade agreements and of people transitioning to permanent residence are not affected by the January 2025 change, so check those cases individually.

Registered marriage certificate, or proof of at least 12 months of living together for a common-law partner.
Evidence of a genuine relationship: wedding photos, joint bank accounts or property papers, communication history and family details.
Copy of the principal's study permit or work permit.
Student route: letter of acceptance, proof of enrolment letter or recent transcripts from the DLI.

Step-by-Step: How to Apply
Confirm eligibility using the table above: check the exact program name and length, or the worker's NOC code, TEER level and permit expiry date.
Decide timing: apply together with the student's study permit or the worker's permit, or apply later once the principal is in Canada.
Collect documents and make sure names, dates and amounts match across every document.
Apply online through IRCC. In the application, choose "Open work permit" as the type of work permit and leave the employer section blank, as IRCC instructs.
Pay the fees and give biometrics at a Visa Application Centre when you receive the instruction letter.
Complete a medical exam if requested, then send your passport when asked.
On arrival, check every detail on the work permit before leaving the port of entry.
