Short answer: Since 28 October 2026, Canada can fine people who give paid immigration or citizenship advice without authorization CAD $5,000, and CAD $15,000 for knowingly submitting false or misleading information for an applicant. Penalties rise for repeat violations, up to CAD $1.5 million in total. For Punjab applicants, the practical lesson is simple: before you pay anyone, confirm who the authorized representative on your Canadian file is, and check that person on the official register.

Canada remains a top destination for students, workers and visitors from Punjab, and families in Jalandhar, Ludhiana, Moga and Hoshiarpur regularly hear of people losing money or facing refusals because of an unlicensed "file agent" or forged documents. IRCC's new penalty system is aimed at those representatives, but the consequences of a bad file still land on the applicant. This guide explains the Canada immigration consultant penalties 2026 in plain language and gives you a checklist to protect your application.

What Changed on 28 October 2026

IRCC announced that its new administrative monetary penalties for immigration and citizenship representatives took effect on 28 October 2026. The final regulations are scheduled for publication in Canada Gazette, Part II, on 4 November 2026. Draft regulations were first published in December 2024, so this change was planned for almost two years.

Violation

Penalty (CAD)

Providing paid immigration or citizenship advice or representation without authorization

$5,000

Knowingly providing false or misleading information on an applicant's behalf, or helping an applicant do so

$15,000

Application approved based on false or misleading information

Additional penalties may apply

Repeat violations

Penalties increase, up to a combined maximum of $1.5 million

IRCC also says it will publish the names of penalized representatives and details of their violations in an online registry, expected to launch in 2027 after the first penalties are issued. Anyone who believes they were penalized in error can request a formal review. You can read the details in IRCC's official news release.

Who the Canada Immigration Consultant Penalties 2026 Apply To

The penalties cover two groups:

  • Paid representatives who are authorized, including licensed immigration consultants and lawyers, if they knowingly submit false or misleading information.

  • People who charge for immigration or citizenship advice or representation without being authorized. In Punjab, this often means an informal "file agent", a travel desk or someone who prepares and submits IRCC forms for a fee without a Canadian licence.

The Canada immigration consultant penalties 2026 target representatives, not applicants. But that does not protect you from the consequences of a dishonest file, as explained below.

Who Is Allowed to Charge You for Canadian Immigration Help

According to IRCC's page on authorized representatives, only these people can charge a fee to represent or advise you on a Canadian immigration or citizenship application:

Type of representative

Must be a member in good standing of

Immigration or citizenship consultant

College of Immigration and Citizenship Consultants (CICC)

Lawyer

A Canadian provincial or territorial law society

Notary (Quebec only)

Chambre des notaires du Québec

Paralegal (Ontario only)

Law Society of Ontario

IRCC's advice is direct: if a representative is not a member in good standing, you should not use their services. Unpaid help, such as a family member filling in a form for free, is treated differently, but you remain responsible for everything in your application.

Why Applicants Still Pay the Price

A fine on an agent does not fix a refused file. IRCC says that giving false or misleading information, even if someone advised you to do it, can lead to refusal, a five-year ban from entering Canada, or loss of citizenship. In its March 2026 statement on immigration fraud, IRCC said it investigated more than 95,000 fraud cases in 2025.

Typical problems behind these refusals include fake bank balances, purchased experience letters, undisclosed previous refusals (from Canada or another country) and job offers that turn out to be scams. Our guide to the Canada misrepresentation 5-year ban explains how these cases unfold and what to do if you receive a procedural fairness letter.

Warning Signs of a Fraudulent or Unauthorized Agent

IRCC lists several red flags. If you see any of these, stop and check before you pay:

  • Pressure to act quickly or pay immediately

  • Requests for large cash payments

  • Promises of guaranteed visas, guaranteed PR or faster processing

  • Requests for money over text, social media or a non-government email address

  • Someone claiming to be an immigration official who contacts you unexpectedly

  • An agent who will not tell you who is listed as your representative on IRCC forms

IRCC is clear that no one can promise a visa or faster processing, and that only IRCC officials can process an application.

Step-by-Step Checklist Before You Hire Anyone

  1. Ask the agency who will be the authorized representative on your Canadian application, and get the person's full name and membership number in writing.

  2. Check that name on the CICC public register (for consultants) or the relevant law society directory (for lawyers), using the links on IRCC's authorized representatives page.

  3. Check that the representative is named on the Use of a Representative form (IMM 5476) in your application, so IRCC knows who is acting for you.

  4. For a Punjab-based office, ask for its licence under the Punjab Travel Professionals (Regulation) Act, 2014 and check it with the district administration. In 2023, for example, the Jalandhar administration cancelled 263 licences of immigration firms and IELTS centres, so licences do change.

  5. Insist on a written service agreement listing fees, services and the refund policy, and pay only through traceable methods with receipts.

  6. Get access to your own IRCC account and keep copies of everything submitted in your name.

  7. Read every form and document before it is submitted. If anything is false or you do not understand it, do not sign.

Already Paid an Agent? What to Do Now

  • Log in and check your file. Make sure you can see what was submitted. If you cannot, ask for copies at once.

  • Compare every detail with the truth. Check education, work history, funds, travel history and previous refusals.

  • Correct mistakes early. If something wrong was submitted, get proper advice quickly. Correcting information before IRCC raises it is better than defending it later.

  • Request your GCMS notes after a refusal to see exactly what the officer recorded. Our GCMS notes guide explains how.

  • Report fraud. IRCC lists reporting options on its website, including its fraud reporting page and the Canadian Anti-Fraud Centre. In India, you can also complain to the local police and the district administration that licenses travel and immigration businesses.

Frequently Asked Questions

What are the new Canada immigration consultant penalties in 2026?

From 28 October 2026, IRCC can fine unauthorized paid advisers CAD $5,000 and representatives who knowingly submit false or misleading information CAD $15,000. Penalties increase for repeat violations, up to CAD $1.5 million combined.

Can I be refused if my agent submitted fake documents without telling me?

Yes. IRCC says false or misleading information, even if someone advised you to provide it, can lead to refusal and a five-year ban from Canada. You are responsible for everything submitted in your name, so read every document before it is filed.

How do I check if an immigration consultant is licensed for Canada?

Consultants must be members of the College of Immigration and Citizenship Consultants (CICC). Search the CICC public register for their name and membership number. Lawyers must be members of a Canadian provincial or territorial law society.

Is a Punjab travel agent licence the same as a Canadian immigration licence?

No. A licence under the Punjab Travel Professionals (Regulation) Act, 2014 allows a business to operate in Punjab. It does not make anyone an authorized representative before IRCC. For paid representation on a Canadian file, the representative must be authorized by a Canadian regulator.

Will IRCC publish the names of fraudulent consultants?

Yes. IRCC says it will publish the names of penalized representatives and details of their violations in an online registry, expected to launch in 2027 after the first penalties are issued.

Can any consultant guarantee a Canadian visa?

No. IRCC states that no one can promise a visa or faster processing, and only IRCC officials can decide an application. Treat any guarantee as a warning sign.
